We represent banks, private lenders, and institutional investors in mortgage lending and workouts — loan documentation, closings, and, when a borrower defaults, foreclosure and enforcement. We are at home with the particular requirements of lending against co-op shares as well as conventional real property, which not every firm handles.
On the origination side, we prepare and negotiate loan documents, review title and survey, clear conditions, and close residential and commercial mortgages and refinances. We move efficiently so funding happens on schedule and the lender's security interest is properly documented and perfected.
Lending against cooperative shares is its own specialty — it is secured by stock and a proprietary lease rather than real property, which means recognition agreements, UCC filings, and lien searches in place of a conventional mortgage and title policy. We handle these co-op loans routinely and know where they differ from real-property lending.
When a loan goes sideways, we represent lenders in workouts, forbearances, and, where necessary, foreclosure and enforcement through to sale and recovery of any deficiency. We work to maximize recovery while keeping the process orderly and well documented.
